CAMP OAKLEY

INDIVIDUAL RELEASE AND WAIVER OF LIABILITY

Camp Oakley, LLC, (“Camp Oakley”) operates and maintains a certain camp property located at the intersection of Weber Canyon Road and South Fork Road just outside of Oakley, Utah (the “Camp”). The Camp is made available for use by religious organizations and other charitable organizations interested in outdoor experiences, including overnight camping. However, currently Camp Oakley does not supervise or maintain any staff at the Camp while such other groups utilize the Camp.

By signing below you certify you are fully aware of the hazards in engaging in outdoor activities at the Camp, including overnight camping. In consideration of being permitted to engage such activities at the Camp, including overnight camping, you knowingly and willingly assume these hazards and recognize they can be dangerous to both life and limb. Camp Oakley does not and will not supervise or otherwise be involved in your or your group’s activities.

In full recognition of such, you hereby release, waive and discharge Camp Oakley, its affiliate organizations and/or entities (including specifically, JKS Family Foundation, a Utah nonprofit corporation), and its/their officers, agents, employees, representatives, members, patrons, guests and invitees (collectively, the “Camp Oakley Parties”), from any and all liability to you, your spouse, legal representatives, heirs and assigns, for any and all losses, claims and/or damages resulting from your use or presence at the Camp, on account of injury to you or your property, even injury resulting in death, while engaging in activities at the Camp. This release and waiver is complete as it is your intent to hold harmless and indemnify the Camp Oakley Parties for any injury that might result while you are on the premises of the Camp. You further agree that you will comply with all applicable state and local laws and regulations and with Camp Oakley’s Rules and Standards relating to the Camp. You acknowledge that you have not been invited or been given license to use any of the property adjoining or surrounding the Camp, and that any use by you of such property invites additional hazards and risks and is undertaken solely at your own risk.

You assume full responsibility for the risk of bodily injury, death or property damage that may occur. You agree this release, waiver and indemnification agreement is intended to be as broad and inclusive as permitted by the laws of the State of Utah. All disputes hereunder shall be brought exclusively in the state or federal courts located in Salt Lake County, Utah.
